Know Your Rights

  • If immigration or law enforcement agents come to your house or stop you DO NOT RUN AWAY; that could be a crime. Immediately call your lawyer.
  • You have the right to a lawyer.  If you cannot afford a lawyer, there are non-profit agencies that can help you get one.  Make arrangements for a lawyer NOW, before you need one. 
  • You have the right to ask if you are being detained or arrested.  If the agents say no, calmly walk or drive away.  If they say yes, immediately ask to contact your lawyer and refuse to say anything more. 
  • You have the right to remain silent.  You can refuse to speak or answer questions without your lawyer present. 
  • You have the right to refuse to be searched unless agents have a warrant signed by a judge with your correct name and address on it.  Without a warrant you can refuse to let agents into your home, to look at your cell phone, or to go through your wallet, purse, backpack, car, or other belongings. 
  • Ask if the agents have a warrant.  If they say yes, ask to see it.  DO NOT open your door or get out of your car.  Have them slide the warrant through a window.

You have the right to refuse to show any documents before speaking with your lawyer. 

Always carry your green card or visa if you have one.  Never carry false papers.

  • Si los agentes de inmigración o de las agencias policiales llegan a su casa o le detienen, NO HUYA; eso podría ser un delito. Llame inmediatamente a su abogado.
  • Tiene derecho a consultar un abogado. Si no puede pagar uno, hay organizaciones sin fines de lucro que pueden ayudarle a conseguir uno. Consiga un abogado AHORA, antes de que lo necesite.
  • Tiene derecho a preguntar si está detenido o arrestado. Si los agentes dicen que no, camine o maneje con calma. Si dicen que sí, inmediatamente pide permiso para contactar a su abogado.  No diga nada más.
  • Tiene derecho a guardar silencio. Puede negarse a hablar o responder preguntas sin la presencia de su abogado.
  • Tiene derecho a negarse a ser registrado al menos que los agentes tengan una orden judicial firmada por un juez con su nombre y dirección correctos. Sin una orden judicial, puede negarse a que los agentes entren a su casa, a revisar su teléfono celular, o a revisar su billetera, bolso, mochila, auto, u otras pertenencias. Pregunte si los agentes tienen una orden judicial. Si dicen que sí, pídales que la vean. NO abra la puerta ni salga del auto. Pídales que la deslicen por la ventana.

Tiene derecho a negarse a mostrar cualquier documento antes de hablar con su abogado.

Siempre lleve consigo su tarjeta de residencia o visa, si la tiene. Nunca lleve consigo documentación falsa.
